مارس الإنسان حقوقه عبر التاريخ بصورة فعلية، ودافع عنها بقوة خشية أن تسلب منه، تلك الحرية التي تتيح له حق الترحل والصيد والتفكير والتعبير، وهو حتى الآن يحاول الحفاظ عليها باستمرار خوفاً من أن يعتدى عليه وتسلب منه وكتاب "حقوق الإنسان بين حلف الفضول وميثاق الأمم المتحدة" الذي ألفه الأستاذ محمد حسن كمال الدين والذي يهدف إلى الإسهام في إنارة الوعي الحقوقي لأبناء أمتنا العربية والإسلامية في مرحلة تشهد اهتماماً عالمياً بقضايا حقوق الإنسان.
وهو محاولة جديرة بالاهتمام لما تقدمه من دراسة في عمق التاريخ والمجتمع القبلي ونظام السيادة حيث يبرز المؤلف فيه مفهوم حلف الفضول وثناء النبي محمد صلى الله عليه وسلم لهذا الحلف وآراء أهل البيت فيه، كما ويبين حقوق المرأة عند أهل الفضول ومفهوم حقوق الإنسان في ظل الشريعة الإسلامية، كما ويتناول معالم الحياة في المجتمع المكي قبيل الإسلام، والمقارنة بين حلف الفضول وميثاق الأمم المتحدة، ويضيف المؤلف في نهاية الكتاب ملحقاً خاصاً يورد فيه مواد القرار الصادر من الأمم المتحدة حول الإعلان العالمي لحقوق الإنسان 1948 وبعض البروتوكولات والاتفاقيات الدولية الخاصة بـ"حقوق الإنسان".
