لا يمكن للمشروع، مهما أوتي من بعد في النظر ومهما تحسّب لما يمكن أن يطرأ من مشاكل ومنازعات، أن يقمع الحلول المسبقة لما يمكن أن يطرحه للقانون من عُقد وتساؤلات.
من هنا كان دور الفقيه وكانت مهمة القاضي الأول يبدي آراءه العلمية شارحاً النص ومعلقاً عليه ومنتقداً له، والثاني يأخذ على عاتقه أمر التطبيق ووضع الحلول القانونية موضع التطبيق العملي. وكثيراً ما يأتي تكامل النص، عن طريق تعديله، ثمرة لعلم الفقيه وتطبيق القوانين من قبل القضاء.
من هنا كان من الأهمية بمكان أن يبقى رجل القانون على اطّلاع دائم على آراءه من سبقه في معاناة النص القانوني لا سيّما على ما صدر من المحاكم من اجتهادات تصبح، مع الزمن، مناراً يسترشد بها كل طالب علم أو رجل قانون.
ولا يخفى ما يهدره الساعي وراءه المعرفة والرأي الصائب من وقت وجهد للوصول إلى غايته. ومن أجل التوفي في الوقت والجهد عمدنا إلى إصدار سلسلة من المصنفات التي تضمنت تصنيفاً للاجتهادات الصادرة في القضايا المدنية.
وإكمالاً لهذه لسلسلة عمدنا إلى إصدار مجموعة سنوية من الاجتهادات: جزء للاجتهادات الجزائية وآخر للاجتهادات المدنية، وقد صدر منها مع نهاية 1996 المصنف السنوي في الاجتهاد لسنة 1996، وها نحن نكمل هذا العمل بإصدار اجتهادات 2014، وهو يتضمن الاجتهادات الصادرة في القضايا المدنية على اختلافها، بدءاً مما صدر عن مختلف غرف محكمة التمييز مروراً بما صدر عن المحاكم الأخرى من قرارات هامة. وقد عمدنا إلى تصنيف الاجتهادات وفقاً لمواضيعها ومن ثم تبويبها داخل كل موضوع على حدة.
