من هنا، كان دور الفقيه وكانت مهمة القاضي الأول يبدي أراءه العلمية شارحاً النص ومعلقاً عليه ومنتقداً له، والثاني يأخذ على عاتقه أمر التطبيق ووضع الحلول القانونية موضع التطبيق العملي، وكثيراً ما يأتي تكامل النص، عن طريق تعديله؛ ثمرة لعلم الفقيه وتطبيق القانون من قبل القضاء.
من هنا، كان من الأهمية بمكان أن يبقى رجل القانون على إطلاع دائم على آراء من سبقه في معاناة النص القانوني لا سيما على ما صدر من المحاكم من إجتهادات تصبح، مع الزمن، مناراً يسترشد بها كل طالب علم أو رجل قانون، ولا يخفى ما يهدره الساعي وراء المعرفة والرأي الصائب من وقت وجهد للوصول إلى غايته.
ومن أجل التوفير في الوقت والجهد تم العمل على إصدار سلسلة من المصنفات التي تضمنت تصنيفاً للإجتهادات الصادرة في القضايا المدنية والقضايا الجزائية، وقد تضمنت الإجتهادات الصادرة عن المحاكم حتى نهاية العام 1995، هذا من ناحية، ومن ناحية ثانية وإكمالاً لهذه السلسلة تم العمل أيضاً على إصدار مجموعة سنوية من الإجتهادات: جزء للإجتهادات الجزائية وآخر للإجتهادات المدنية، وقد صدر منها مع نهاية العام 1996 المصنف السنوي في الإجتهاد ولسنة 1996.
ويأتي هذا المصنف الذي يكمل هذا العمل بإصدار إجتهادات العام 2016، وهو يتضمن الإجتهادات الصادرة في القضايا المدنية على إختلافها، بدءاً مما صدر عن مختلف غرف محكمة التمييز مروراً بما صدر عن المحاكم الأخرى من قرارات هامة، وقد تم تصنيف الإجتهادات هنا وفقاً لمواضيعها ومن ثم تبويبها داخل كل موضوع على حدة، والتي جاءت على النحو التالي: الفرع الأول: إيجارات، الفرع الثاني: محاكمات مدنية، الفرع الثالث موجبات وعقود، الفرع الرابع: قضايا عقارية، الفرع الخامس: إجتهادات تجارية، الفرع السادس: تنفيذ وحجز، الفرع السابع: عمل وضمان إجتماعي، الفرع الثامن: أحوال شخصية، الفرع التاسع: إستئناف، الفرع العاشر: تمييز، الفرع الحادي عشر: قرارات الهيئة العامة لمحكمة التمييز.
