إن القواعد للمرافعات المدنية والتجارية تحتل مكاناً بارزاً في القانون، ولذا فهي ذات أهمية كبيرة للمهتمين بدراسته والعاملين في حقل القضاء، من قضاة ومحامين ومن يلجأ إلى دُور العدل من متخاصمين ومتداعين، وإن الكتابة في مثل هذا الموضوع الحيوي، لهي مهمة جداً، وبالخصوص كتلك التي جاءت في هذا الكتاب والتي بنيت على دراسة مقارنة مستخلصة من التشريعات الوضعية النافذة في البلاد العربية وعلى الرغم من التركيز الواضح في هذه الدراسة، فقد جاءت عامة وشاملة، بحيث تفيد القارئ من ناحية الغرض الذي يستهدفه من قراءته من ناحية فهم قانون المرافعات المدنية الوطني أو غيره من القوانين القابلة له في الدول العربية، جاءت الدراسة ضمن قسمين، بحث القسم الأول في أهمية قوانين الرافعات وفي التشريع الوضعي والدعوة وولاية القضاء والاختصاص والمحاكمة وحسم الدعوى وإصدار القرار وهذا الترتيب في البحث يقوم على أساس السير المنطقي للدعوى أمام القضاء. وبحث القسم الثاني في الاعتراض على الحكم النيابي والاستئناف والطعن بالنقض، وإعراض الند وإعادة المحاكمة وتصحيح القرار.
