يعد التصحيح من الإجراءات المهمة والضرورية التي تلجأ إليها السلطة القضائية لمعالجة ما قد يشوب الحكم الجزائي من أخطاء مادية أو قانونية أو واقعية يرتكبها القضاة لأسباب مرفقية أو شخصية خلال مرحلة التحقيق أو المحاكمة أو إصدار الحكم...
والهدف من التصحيح هو إعادة الأمور إلى نصابها وتأكيد الحقيقة الواقعية، وبذلك يعد وسيلة لضمان حقوق الأفراد ومصلحة المجتمع؛ ومن الطبيعي أن التصحيح يتطلب بالضرورة الحديث عن الحكم الجزائي أولاً ومن ثم بيان الخطأ الذي يشوبه ثانياً ليتسنى لنا بحث تصحيح ذلك الخطأ الذي هو أساس هذه الدراسة.
وبناء على ما تقدم وتماشياً مع عنوان الكتاب الذي اقتضت طبيعة بحثها تقسيم الموضوع على بابين: تناول الكاتب في الباب الأول طبيعة الخطأ في الحكم الجزائي ونطاق تصحيحه، ويكون ذلك في فصلين بحث في الفصل الأول: طبيعة الخطأ من حيث كونه ذا طبيعة مادية أو قانونية أو واقعية؛ أما الفصل الثاني: بحث فيه نطاق التصحيح حيث نعالج في ذلك حالتي بطلان الحكم وإنعدامه.
أما الباب الثاني: فخصصه لطرق تصحيح الخطأ وأثاره، إذ تناول ذلك في فصلين، فرد الفصل الأول لطرق التصحيح، أما الفصل الثاني فتطرق فيه إلى أثار التصحيح سواء بالنسبة للأعمال الإجرائية السابقة على الحكم الجزائي، أو الأعمال اللاحقة للحكم، وأثره في حجية الحكم.
وأخيراً ختم دراسته بخاتمة لخص فيها ما توصل إليه من نتائج وما يتعين تقديره ومراعاته والأخذ به في مجال تصحيح الأخطاء التي تشوب الحكم الجزائي وضمان صحته وسلامته.
