تقدم براءة الإختراع حقاً لصاحبها ولمدة زمنية محددة، تمنع غيره من إستخدام حقه في الملكية على الإختراع سواء كانت ذات قيمة كبيرة أم لا.
وقد وجدت هذه البراءة لحماية حقوق صاحبها على الإختراع، وتطورت بمرور الزمن حيث استمرت فكرة الإحتكار في التطور منذ القرن الثالث قبل الميلاد حتى وصلت إلى شكل البراءة التي ترتب إحتكاراً لصاحبها في إستغلال الإختراع، وهي ما تسمى حالياً ببراءة الإختراع.
يعرض المؤلف من خلال هذه الدراسة موضوع براءات الإختراع كدراسة ما بين أحكام القانونين المصري والأردني، من خلال بابين الأول عرض فيه التنظيم القانوني لهذه البراءات من خلال التطرق إلى الشروط الموضوعية والشروط الشكلية الواجب توافرها في الإختراع وطلب الحصول على البراءة حتى تُمنح عن الإختراع، وكذلك إلى الحماية القانونية لبراءات الإختراع من خلال التعرض إلى الحماية القانونية التي رتبها القانون للبراءات بشتى أشكال الحماية من مدنية وجنائية وتدابير إحتياطية، وحماية دولية.
عرض الباب الثاني الآثار القانونية لبراءات الإختراع من حيث الحقوق والإلتزامات التي ترتبها البراءة لصاحبها، وإلى إنقضاء براءات الإختراع أخيراً من خلال تبيان أسباب إنقضاء البراءة وأحكام بطلانها.
