لقد علم من الشريعة المطهرة أن الزواج علاقة يتعايش بها الرجل والمرأة، وينشأ بعقد بالتراضي، وتترتب عليه حقوق وواجبات، ويتحقق به النسب إجمالاً. وهو حالة شخصية يصنعها الإنسان بقرار منه، ومعاملة مقصودة لأهدافها المعيَنة، أدخلها الدين في منظومة قيمه ةتشريعاته، كسائر المعاملات، حرصاً منه على هدي الإنسان وصالح المجتمع. ونظراً لمل قد يعرض لهذا التعايش من شوائب، فيكره بسببها أحد الزوجين أو كلاهما صحبة الآخر، فيخشى أن لا يؤدي حقَه، ويرغب في مفارقته، فإنَ الشريعة المطهَرة قد أفسحت لهما مجال (المفارقة) من خلال الطلاق الإختياري والقهري أو الفسخ، وهي أمور قد صارت تحدث كثيراً في زماننا، وخصوصاً الطلاق، حيث تحدثت الإحصائيات العديدة عن إرتفاع نسبة الطلاق في العديد من الدول في مختلف أنحاء العالم. وقد خلصت بعض الدراسات التي إنبنت على تلك الإحصائيات إلى أن السبب في ذلك هو إستقلال المرأة العاملة الإقتصادي، وتغيَر مزاج الرجل والمرأة العاطفي. وتأخر سن الزواج المقرون بعدم النضج الإجتماعي نتيجة البقاء طويلاً في مرحلة الدراسة وعدم الإنخراط الفاعل في أسرة الأهل. من هنا تأتي أهمية هذا الكتاب التي تحدث عن الطلاق وأسبابه وآثاره، دون أن يغفل أسباباً أخرى لـ(المفارقة) غير الطلاق القهري والإختياري والفسخ، هي ما قد يحدث بسبب فقدان الزواج بعض أركانه، أو بسبب الموت. وذلك بهدف بيان أحكامه والحكمة منه.
