Book Description
تستخدم الدولة لممارسة نشاطها الضبطي ونشاطها المرفقة، وسائل متعددة تتمثل في الوسيلة البشرية (الموظفون العموميين) والوسيلة القانونية، القرارات الإدارية والعقود الإدارية، والوسيلة المادية (الأموال العامة).
ويعالج هذا الكتاب عدة موضوعات هامة تدور في تصميمها حول الوسيلة البشرية، المتمثلة في الموظفين العموميين على أساس أنّها أداة تستخدمها الإدارة لتحقيق أهدافها.
وقد قُسّم هذا الكتاب إلى عدة فصول، كل فصل منه تناول جزئية معينة وفصّل فيها قدر الإمكان. أمّا الفصل الأول فانصب محور اهتمامه في بيان كيفية تنظيم الوظيفة العامة، وذكر الجهة المسؤولة عن إنشاء أو إيجاد الوظيفة العامة، كما بيّن الأسس والمعايير التي تستند عليها الدول في ترتيب وتوصيف الوظائف العامة، بين المقصود بالموظف العام وعلاقته بالدولة أو الإدارة.
كما ذكر الأسس التي عليها تعيين الأفراد في الوظائف العامة مشيراً إلى حقوقه الموظفين في الإجازات والرواتب والعلاوات والرفيعات وغيرها. مركّزاً في الوقت نفسه على واجبات الموظفين.
أما الفصل الثاني فقد اهتم بدراسة القرارات الإدارية، كونها أهم الوسائل القانونية التي تستخدمها الإدارة لممارسة نشاطها وتحقيق هدفها، حيث يوضّح ماهيّة القرار الإداري، وخصائصه، ونبّه إلى ضرورة تمييز القرارات الإداري.
في حين عني الفصل الثالث بيان ماهية العقود الإدارية, فبيّن أركان العقد ووضح مفهومه كما أشار إلى أنواع العقود الإدارية، والقواعد التي تحكم إبرام العقود الإدارية.
كما تناول آثارها بينما الفصل الرابع والأخير فقد اكتفي بالإشارة إلى الأموال العامة، فبيّن الاستعمال العام والاستعمال الخاص لها، كما تتطرق إلى وجود الحماية القانونية التي لابد منها للأموال العامة.
