مصنف هذا الكتاب هو الحافظ الإمام أحمد بن الحسين البيهقي، ولد في خسروجرد، من قرى بيهق، بنيسابور ونشأ في بيهق ورحل إلى بغداد ثم الكوفة وغيرهما، وطلب إلى نيسابور، فلم يزل فيها إلى أن مات، قال عنه إمام الحرمين: ما في شافعي، إلا وللشافعي فضل عليه غير البيهقي، فإن له المنة والفضل على الشافعي لكثرة تصانيفه في نصرة مذهبه وبسط موجزة وتأييد آرائه". وقال الذهبي: "لو شاء البيهقي أن يعمل لنفسه مذهباً يجتهد فيه لكان قادراً على ذلك لسعة علومه، ومعرفته بالاختلاف".
