تتحدث الأبحاث التي يشتمل عليها هذا الكتاب عن تصنيف للاجتهاد من منظور مختلف. لا يماثل التصنيفات السائدة في الدراسات الشرعية، باعتباره يستند إلى أساس آخر، لم ينته إليه الكثير من دارسي الفقه وأصوله وقد سمّاه "الاجتهاد التحقيقي" وهو ينهج منهجاً مغايراً في البحث والاستدلال، لأنه لا يقف بالاجتهاد عند عتبة الفقه خاصة، بل يمتد إلى كافة العلوم الإسلامية، ويغدو كما يرى محمد رضا حكيمي روحاً تبعث الفاعلية والحركة والتطور في الفلسفة وعلم الكلام، وعلوم القرآن والتفسير، فضلاً عن الفقه وأصوله، وبقية المعارف الإسلامية.
كما ويقترح المؤلف تعميم روح الاجتهاد وسريانها في جميع مناشط التفكير الإسلامي، يقترح أيضاً مدلولاً بديلاً للاجتهاد يغادر فيه الاجتهاد التمحور حول أحكام الدين خاصة، إلى اتخاذ أهداف الدين هي الأساس والموجه لعملية الاستنباط، بحيث يكتسب الحكم مشروعية من انتمائه للعدل، وقدرته على إشاعة القسط في الحياة، باعتبار الأحكام إنما وضعت لهدف معين، وإن هاجس "الاجتهاد التحقيقي" هو اكتشاف ذلك الهدف، ثم نصبه ميزاناً لعمليات الاستنباط الفقهي، بنحو تكون فيه جميع الأحكام المستنبطة من أدلتها باتجاه تحقيقي (ليقوم الناس بالقسط).
وهدف المؤلف من وراء كتابه هذا التعريف بمهنج هذا الاجتهاد الذي يرى منه السبيل الوحيد لإعادة بناء العلوم الإسلامية في سياق متطلبات المسلم المعاصر، وإيحاء رسالة الأنبياء في إقامة مجتمع القسط والعدل.
