يتضمن الكتاب دراسة قانونية للشكل كأحد أركان القرار الإداري باعتباره المظهر الخارجي أو الصورة التي يظهر بها القرار. ومع ذلك فليس هذا هو الأصل، فالأصل أن القرار الإداري ليس له شكل واحد يتعين أن يصدر به، فيمكن أن يكون مكتوباً أو شفوياً أو غير ذلك من الأشكال ما لم ينص القانون على خلاف ذلك، ومع ذلك فإن إثبات وجوده والإحتجاج به قبل الغير قد يتطلب صدوره في صورة صريحة، والصورة المعتادة له أن يكون مكتوباً. وتعد قواعد الشكل على جانب كبير من الأهمية فهي تقوم كحاجز وموازن لسلطات الإدارة الخطيرة في مجال القرارات الإدارية، فإذا كانت الإدارة تتمتع في هذا الخصوص بحق التنفيذ المباشر والسلطة التقديرية وقرينة السلامة، فان عليها أن تتبع الشكل الذي ترسمه القوانين واللوائح لتلك القرارات وذلك حتى تبقى قراراتها دائماً ضمن دائرة المشروعية.
ونظراً للدور الكبير الذي تلعب الأشكال في حماية حقوق المتعاملين مع الإدارة فقد عمدت بعض الدول إلى تنظيم أحكام قواعد الشكل ضمن تشريعاتها، كما أوردت أحكام بعض الأشكال ضمن دساتيرها، بينما تركت معظم الدول الأخرى لأحكام القضائ والنصوص القانونية المتفرقة لفرض الإلتزام بقواعد الشكل في القرارات الإدارية، كما أخضعت هذه الأشكال لنوعين من الرقابة وهما الرقابة الإدارية التي تتولاها الإدارة بنفسها، والرقابة القضائية والتي يمارسها القضاء الإداري لمراقبة مدى احترام قواعد المشروعية المتعلقة بالشكل المقررة لإعداد وإصدار القرار الإداري.
