إنّ الإنجاب مطلب فطري يسعى لتحقيقه الإنسان بوسيلة شرعية وهي الزواج الطاهر العفيف، فالإنسان بطبيعته يحب الأولاد ويحرص عليهم، وهذا ما أكده القرآن الكريم حيث قال الله تعالى: (المال والبنون زينة الحياة الدنيا) سورة الكهف: من الآية 46. فالذرية نعمة كبرى لا يعرف قدرها إلا من حرم منها، لذا جعل الله تعالى الأولاد نعمة أوجب الشكر عليها.
وإن طلب الولد مشروع في الشريعة الإسلامية الغراء؛ لأنه مطلب من مطالب فطرته الكامنة في نفسه، لذا ندب الإسلام إلى التزوج من الولود من النساء، فقد جاء رجل إلى النبي صلى الله عليه وسلم فقال: إني أصبت امرأة ذات حسب وجمال وإنها لا تلد، أفأتزوجها؟ قال: لا، ثم أتاه ثانية فنهاه، ثم أتاه الثالثة فقال :(تزوجوا الودود الولود فإني مكاثر بكم الأمم) ( ).
وانبثقت أهمية الدراسة لهذا الموضوع من خلال المتابعة في الميدان ضمن العمل في المحاكم الشرعية الأردنية، إذ أثار لدي حب الفضول البحث بهذا الموضوع كونه صدر حديثاً العمل به، للتعرف على مستنده الشرعي وحكمه، وقد كانت هنالك بعض القضايا لبعض الحالات منصبة على الفسخ لعدم الإنجاب.
