كان وما زال موضوع تعذيب المتهم يحتل مركز الصدارة في ميدان الدراسات الشرعية والقانونية لتعلقه بموضوعة حقوق الإنسان، لذلك هذا الكتاب يحاول أن يسلط الضوء على مدى قدرة القانون الجنائي العراقي في الحد من حالات التعذيب المتزايدة التي ترمي إلى إنتزاع الإعتراف من المتهم، ومدى تقدير القانون للقيمة القانونية لهذا الإعتراف الذي أصبح الشغل الشاغل للمحقق الذي، غالباً، لا يفقه الحد الأدنى لعلم التحقيق وما يرافقها من حقوق متأصلة للمتهم الذي أصبح (في نظر البعض) في الأصل مدانا حتى تثبت براءته، وبالنظر إلى كون الدستور العراقي في المادة (2) ينص على أنه (لا يجوز سن قانون يتعارض مع ثوابت أحكام الإسلام).
ارتأينا أن نعزز الكتاب ببحث الجنبة الشرعية عن طريق مقارنتها بالقانون الوضعي مركزين ببحث وزن الإعتراف الناشئ عن التعذيب بالإضافة إلى مدى تحقيق العقوبة لمبدأ العدالة الجنائية، وذلك عبر خطة تتكون من ثلاثة فصول، في الفصل الأول ثم بحث مفهوم التعذيب، أما في الفصل الثاني فقد تم إيضاح أركان جريمة التعذيب واختتمنا الكتاب بفصل ثالث يتناول عمل إستراتيجية بسيطة قوامها تشخيص أسباب إنتشار التعذيب وأهم الخطوات التي تحد منه.
