لأطراف العقد الحرية في تحديد موعد تنفيذه، فيكون حالاً او مؤجلاً، فإذا جعلوه مؤجلاً فقد يصدر من المدين قبل حلول الأجل ما يُستنتج منه أن التنفيذ لن يحصل في موعده، كما لو صرح بذلك أو اتخذ مسلكاً يدل عليه أو قام بما يجعل التنفيذ مستحيلاً.
وقد واجهت بعض القوانين هذا الوضع بمبدأ عام يجيز للدائن إنهاء العقد والمطالبة بالتعويض فوراً وإن لم يكن الموعد المحدد للتنفيذ قد حل بعد، ويطلق على هذا المبدأ في القانون الأنكلوأميركي "الإخلال المسبق بالعقد Anticipatory breach of contract وقد تبنته قوانين وإتفاقيات ومبادئ أخرى، كإتفاقية فينا بشأن البيع الدولي للبضائع لسنة 1980 ومبادئ عقود التجارة الدولية اليونيدروا ومبادئ العقد الأوروبية.
والهدف الرئيس لهذا الكتاب الذي أصله رسالة ماجستير نوقشت في جامعة بابل في (2011) هو دراسة الفكرة في القوانين التي تبنتها، وإستخراج الأحكام المشابهة في القوانين المدنية ومقارنتها ببعضها من أجل معرفة التنظيم الأكثر فاعليّة.
وقد قسمنا الكتاب على فصلين: الأول في مفهوم الإخلال المسبق بالعقد والثاني في آثاره، وتوصلنا إلى أن الإعتبارات العملية التي بنيت عليها الفكرة في القوانين التي تبنتها تقوم على حاجات قد توجد في أي مجتمع، ولذا فمن الممكن الإستفادة من هذه التجربة وتنظيمها بقاعدة عامة تساعد على مرونة التعامل التجاري وحفظ حقوق المتعاقدين، وبما ينسجم مع الإعتبارات السائدة عندنا والقواعد القانونية المنظمة للتجارة الدولية التي نأمل أن تأخذ بلداننا مكانها المستحق منها.
