يستمد موضوع بحثنا أهميته، من أهمية البيع الدولي ذاته، فإذا سلمنا بأهمية تنفيذ الأخير على الصعيد الدولي والداخلي، بوصفه وسيلة للتنمية وإنتقال وتداول رؤوس الأموال، أمكننا أن ندرك أهمية وخطورة موضوع الإخلال بتنفيذه، وضرورة وضع القواعد اللازمة، للحد من آثاره الضارة.
ولقد حددنا موضوع بحثنا بالإخلال بالتنفيذ في بيوع التجارة الدولية، فهو يتناول الإخلال بالتنفيذ فقط، وقد قصدنا إستخدام هذا المصطلح بوصفه جامعاً ومانعاً من دخول غيره، ذلك أن الإخلال بالعقد يمكن أن يفهم منه الإخلال بإبرامه أيضاً، وهذه الحالة تخرج عن نطاق بحثنا، لذا فضلنا إطلاق الإخلال بالتنفيذ في عنوان بحثنا.
ويتناول بحثنا الإخلال بالتنفيذ في بيوع التجارة الدولية، وبذلك يخرج عن نطاق بحثنا موضوع الإخلال ببقية عقود التجارة الدولية، وسبب ذلك صعوبة بحث هكذا موضوع في جميع عقود التجارة الدولية، وذلك لإختلاف طبيعتها وتنوع الإلتزامات الناشئة عنها، فضلاً عن تعدد وإختلاف القواعد التي تحكمها حتى داخل البلد الواحد، الأمر الذي يستحيل معه وضع قاعدة عامة تطبق على جميع عقود التجارة الدولية.
سنعتمد في هذا البحث المنهج التحليلي المقارن، إذ سنعمد في بحثنا إلى دراسة الموضوع في النظامين اللاتيني والانكلوامريكي، وعلى الصعيد الدولي سنقوم بعقد المقارنة بين إتفاقيات التجارة الدولية التي نظمت أحكام الإخلال بالتنفيذ، ثم نقوم بتحليل ودراسة كل جزئية، في ضوء مختلف الآراء الفقهية والقضائية.
وكذلك تحليل القواعد القانونية الداخلية والدولية وبيان أبعادها القانونية وآثارها.
