يمثّل أهمية في ضرورة إستيعاب الأساس الفلسفي الذي يصدر عنه التشريع الإسلامي في أحكامه، لغرض فهم جزئياته في ضوء ذلك؛ تحقيقاً لمراد الشارع ومقصوده من التكليف؛ إذ إن تفنّن طرائق التشريع في سنّ الأحكام، بين الإجمال والتفصيل، والتعميم والتخصيص، والتقعيد والتفريع؛ يستوجب نظرةً شمولية تستوعب هذه المنظومة، وتتصوّر الشريعة صورةً واحدة يخدم بعضها بعضاً، ولا يُطلب منها الحكم على حقيقة الإستنباط إلاّ بجملتها، لا من دليل واحد منها، أيّ دليل كان، وهو الأمر الذي ينفي عن الشريعة وهم التناقض والتعارض، كما أنّ خضوع الواقع لقانون السيرورة، وسنّة التبدّل، وطروء النوازل على السّاحة الفقهية بتسارع مذهل؛ يحتِّم على المجتهدين مواكبة المستجدّات بالتسارع نفسه، ولا يتأتّى ذلك في ظلّ محدودية النّصوص الجزئية إلاّ من خلال العمومات، والقياس على القواعد، والإستصلاح المرسل، وأساس ذلك كلّه هو الكلّيات التشريعية، وهو الأمر الذي يحفظ للشريعة صلوحها لكل زمان ومكان.
من هذه المنطلقات استهدف هذا الكتاب بيان حقيقة الكلّيات التشريعية، وأنواعها، ومراتبها، وخصائصها، ومسوِّغاتها، ومكانتها في النسيج التشريعي: الكتاب، والسنّة، وفقه الصحابة رضي الله عنهم، والمدارس الفقهية الأربعة، كما تغيّا بيان الوظائف النظرية المنوطة بالكلّيات التشريعية، وكيفية تأثيرها في الإجتهاد والفتوى، مع إستخلاص الضوابط المنهجية لذلك، ثمّ إعطاء نماذج تطبيقية عديدة؛ ربطاً بين النظرية والواقع العملي.
