في هذا الكتاب استُهلَّت في مدخلها بالكشف عن حقيقة الخلاف الفقهي القائم بين حملة الشَّريعة الغرَّاء، وأبانت عن الأسباب الجوهرية التي اقتضته، سواءً ما ارتبط منها بالنَّاحية الموضوعية المتعلِّقة بشخصيات العلماء والباحثين من حيث اختلاف مداركهم العقلية، وخصائصهم النَّفسيَّة التي أنتجتها عواملُ كثيرة، أم من جهة تعلُّقها بطبيعة الأدَّلة ذاتها وخصائص المنهج الذي عُرضت به، كما شرحت مقصد قابليَّة الشريعة للإختلاف، ممِّيزة بين أنواعها مقبولها ومرذولها.
ولقد ركَّزت الدِّراسة على موضوع تحريم الإنكار في مسائل الإجتهاد، وبرهننت أنَّ ذلك لا يعني أنَّ الحق متعدِّد، بل واحدٌ تعذَّر الوقوف عليه بيقين، وفرَّقت بين الخلاف الضَّعيف والخلاف القوي، كما بسطت الكلام في نقض إجتهادات المختلفين بعضها ببعض، متى يجوز؟ ومتى لا يجوز؟ ثمَّ بحَثت قضية تغيُّر الأحكام بتغيُّر مناطاتها، وأقامت الدَّليل القاطع على أنَّ ذلك ممَّا لا يُنكر، وقبل الختام شرحت الأصل الفقهي الكبير (مراعاة الخلاف)، وبيَّنت عظيم أثره في تحقيق الغاية المنشودة، ثمَّ حَطَّت رَحلها إنتهاءً عند باب الإحتياط، ودَعَتْ للأخذ بالأحزم والأورع والأسلم للعاقبة إذا شجرت حجج المذاهب.
