كان هناك في القرون الماضية شيء من الاكتفاء الذاتي في دول العالم، من دون حاجة إلا إلى القليل من الصفقات الاقتصادية بينها. لذلك لم يكن هناك إلا القليل من المنازعات مما لا يدعو إلى إنشاء نظام لتنازع القوانين. ولكن، ما إن تزايدات الصلات بين الدول واتسعت حتى أدت التجارة إلى نشوء اعتماد اقتصادي متبادل. وظهرت الحاجة إلى إقامة وسائل لفض المنازعات الدولية، ومنها المنازعات التجارية. وكانت هذه الحاجة على أشدها في ما يتعلق باتفاقيات استغلال المصادر الطبيعية في أقطار أخرى، أي اتفاقيات الامتياز. إن مركز هذه الاتفاقيات وأثرها هو مركز اهتمام هذه الأطروحة.
وسنقدم في القسم الأول من هذه الأطروحة أهدافها، وتعريفاً للأنواع المختلفة من اتفاقيات الامتياز، ولا سيما ما يتعلق منها العلاقة بين الأقطار المصدرة للنفط والأقطار المستوردة له. ويعقب ذلك النظر في الطبيعة القانونية لاتفاقيات الامتياز في الأنظمة القانونية المختلفة.
وسننظر في القسم الثاني في القضايا المتعلقة باختيار القانون ومكان التقاضي بشأن المقاولات، وما تعنيه هذه القضايا لاتفاقيات الامتياز على الأخص. ثم ننظر في القضايا المتعلقة باختيار قانون الدولة باعتباره القانون الموضوعي لعقد بين دولة ما ومواطن لدولة أخرى. وسيتضمن ذلك أيضاً القضايا التي لم يتم فيها تعيين اختيار القانون مع البحث في المسألة الآتية: هل يمكن تطبيق مبادئ القانون الدولي أو المبادئ العامة للقانون إما بصفتها القانون المناسب أو لتعضيد هذا القانون؟ إن هذه القضايا تنشأ على ألخص بين الدول النامية والدول المصدرة للرأسمال.
وستناول في القسم الثالث من هذه الأطروحة موضوع استقرار اتفاقيات امتياز النفط، وسيتضمن ذلك مناقشة الاعتراف الآخذ بالظهور لمفهوم السيادة الدائمة على المصادر الطبيعية، غذ أخذت أقطار العالم الثالث تكافح من أجل استعادة سيطرتها على مصادرها الطبيعية.
