لا يخفى على أحد ما للسلع والمنتجات من أهمية قصوى، فقد أضحت بأنواعها المختلفة جزءً هاماً من حياتنا اليومية لا غنى للإنسان عنها في حركته وسكونه، وفي عمله ومسكنه؛ ولكن على الرغم من كل ما حققته هذه السلع والمنتجات من فوائد لجمهور المستهلكين، إلا أن في الواقع حملت بعض المضار بالنسبة غليهم، فخطورة مكونات هذه السلع، وتعقد إستعمال هذه المنتجات، أدى إلى زيادة وتفاقم الحوادث الناشئة عن حفظها أو إستخدامها من قبل هؤلاء الأخيرين؛ بسبب عدم إحاطتهم علماً - وبصورة مسبقة - بهذه الأخطار، وكيفية تفاديها، من قبل الممتهنين الذين يقومون بإنتاجها أو توزيعها.
لهذه الأسباب، كان لا بد من البحث عن إطار قانوني يمكن من خلاله حماية المستهلكين من المخاطر الكامنة في السلع والمنتجات التي تصل إليهم بمختلف طرق التداول لا سيما عقد البيع الذي يُعد من أهمها، وذلك من خلال إلزام الممتهن - سواء أكان منتجاً أم موزعاً - بأن يوضح خصائص هذه السلع والمنتجات، وطريقة إستخدامها والمخاطر المرتبطة بهذا الإستعمال، وكيفية الوقاية منها.
وتأسيساً لما تقدم، فقد سلطت هذه الدراسة الضوء على الإلتزام بالتحذير في مجال تداول المنتجات الخطرة، بشقين: أحدهما شخصي: يبحث في مفهوم هذا الإلتزام، وكيفية الوفاء به، والآخر موضوعي: يبحث في أحكام إنعقاد المسؤولية المدنية الناشئة عن الإخلال بالإلتزام بالتحذير، وكيفية دفع هذه المسؤولية وأثر إنعقادها؛ من خلال دراسة تحليلية مقارنة بين القانون العراقي، واللبناني، والفرنسي عندما يقتضي الأمر ذلك.
وقد خلصت هذه الدراسة إلى جملة من النتائج، أعقبتها مُقترحات بشأن حماية المستهلك من زاوية الإلتزام بالتحذير يمكن أن تكون أنموذجاً يحتذى به عد وضع أو تعديل أي قانون يخص المستهلك، لا سيما القانون رقم (1) لسنة "(2010) الخاص بحماية حق المستهلك العراقي"، "والقانون رقم (659) لسنة (2005) الخاص بحماية المستهلك اللبناني".
