عقد التخارج من العقود التي تعد منظمة لجانب مهم من جوانب النشاط الإنساني متمثلة في تصرف الوارث لنصيبه، ويعد عقد التخارج من العقود الناقلة للملكية فيما بين الورثة، وهو من الموضوعات التي لم تنل حظها من البحث القانوني في نطاق القانون المدني وركزت أغلب الدراسات الشرعية على جانب الأحوال الشخصية في هذا الموضوع وابتعد عن معالجة هذا العقد الكثير من المتخصصين في مجال القانون المدني تاركين الأمر لقانون الأحوال الشخصية وشراحة، إذ أن هذا العقد متعلق بجانب مهم من جوانب التصرفات الإنسانية ألا وهي الحصة في التركة وإمكان التصرف بها من قبل الوارثين فيما بينهم لكسب أموال إضافية، فعلى الرغم من هذا الأهمية وكثرة التداول هذا العقد في الواقع العملي ومعالجته في القوانين المقارنة كالقانون المدني الأردني والمعاملات الإماراتي لم يعالج المشرع العراقي في القانون المدني رقم 40 لسنة 1951 النافذ ولا في قانون والأحوال الشخصية رقم 188 لسنة 1959 المعدل هذا العقد إلا في نصوص إجرائية في القانون التسجيل العقار برقم 43 لسنة 1971 المعدل.
