لأننا بحاجة إلى ترشيد نظر الفقيه، والكشف عن المؤثرات التي تتحكم في رؤيته وفي إنتاج خطابه حتى يكون أقرب إلى الوصول للحقيقة.
ولأن الأخطر في هذه المؤثرات هي تلك التي تتسلل بخفية إلى رؤية الفقيه دون أن يشعر فتشكل كومة من الحُجب التي تحجب الرؤية وتعيق البصيرة.
نفسية الفقيه، عاداته وعادات مجتمعه، البيئة التي نشأ فيها، الأغلال التي يصنعها الاستبداد والتسلط،… حُجب بعضها فوق بعض، ربما حرمت أهل الفقه من إدراك النور القابع خلف تلك الحُجب.
تأتي هذه الدراسة الموجزة رحلة عابرة عبر هذه الحجب تستجلي أبعادها وتسبر أغوارها وتحاول قدر الإمكان أن تزيح هذه الحجب أو تُقلل من آثارها.
تبدأ هذه الدراسة باستعراض لأهم تلك الحُجب التي لابد للفقيه أن يعترف بها، وتنتهي بمقترحات لتجاوز تلك الحُجب ليكون أكثر قرباً لإنتاج الأحكام على الوجه الأكثر قرباً من الشريعة.
