على قاعدة أن الشريعة الإسلامية، هي شريعة لجميع البشر، شاملة لجميع شؤونهم وأحوالهم، وصالحة لكل زمان ومكان ؛ إذ أن الله تعالى جعل أحكامها وقواعدها وأصولها كافية وافية، فلا تضيق بحاجات الناس، وما يجد من أمورهم وأحوالهم، اختار مؤلف هذا الكتاب الحديث عن مسألة مهمة، يُثار حولها الجدل والنقاش وهي "العقوبة الجسدية" مستعرضاً آراء الفقهاء مقارناً إياها مع ما يراه ذوو القانون الوضعي، مثبتاً صواب ما عن الأصوليين، وبطلان ما عن الآخرين بالبرهان. إذ أن المؤلف رأى "أن الكلام حول العقوبة الجسدية وإثبات صحة ما جاء في الشريعة الإسلامية من الأمور المهم طرحها والتعرض لها، لأسباب، أهمها القول أن الإسلام آخذ في معالجة الجرائم بأسلوب وحشي من جهة، وغير وافٍ من جهة أخرى" فكان إثبات غلط هذه الفكرة ومنافاتها للواقع أمر مهم، ولهذا نراه يقيم الدليل القاطع على أن العقوبات المقررة في الإسلام عقوبات حقّة، مؤيداً ذلك بوقائع حيّة ...
وفي هذا الإطار، يبحث المؤلف في فلسفة العقوبة إسلامياً والهدف من تشريعها، وآثارها من النواحي الإنسانية والسياسية والإجتماعية والأخلاقية، مشيراً إلى علّة التحريم والعقاب، وإلى الأصول التي قامت عليها العقوبة، وهي "القرآن الكريم" و "الحديث الشريف" ، بعتد ذلك يتكلم في جرائم الحدود والقصاص والتعزيز. كما يبيّن من جانب آخر نظرة القانون الوضعي إلى العقوبة الجسدية، ومفهوم الجريمة فيه ثم كيفية مواجهتها بشكل عام بعد استعراضها. مع إشارة المؤلف بأنه عمله ليس "المقارنة بين التشريع الرباني الواقعي وبين التشريع الوضعي وإنما بين ما يراه الفقيه الإسلامي واقعاً وبين التشريع الوضعي.
