منذ أن أصبح مفهوم الشريعة السند الأساسي لنظرية السلطة في الإسلام ، لم يكفّ هذا المفهوم ، بصفة مطّردة ، عن استقطاب الجهد الفكري للساحة السياسية العربية والإسلامية ، ولا سيما في الوقت الراهن .
ثمّة إشكاليات كثيرة يثيرها مفهوم تطبيق الشريعة ، ليس أقلها إشكالية المفهوم ، فإننا نواجَه بأشكاليات أخرى ؛ تلك المتصلة بمختلف الإرتباطات التي للحق في حياة الناس . هنا يجري الحديث عن الأدوار النفسية والإجتماعية والسياسية التي يؤديها الحق . وقد تكون مشكلة الطاعة ، في اتصالها بمسألة الإنتماء ، أبرز هذه المشكلات ، التي تنحسر فيها الفجوة بين السياسي والإجتماعي والنفسي . فمن هذا المنظور ؛ هل يمكن للشريعة أن تكون أداة توفيق بين نوعين من الإنتماء ( الإنتماء السياسي والإنتماء الديني ) ، يتأسس عليهما نوعان من الطاعة للسلطة ، فينتجان نوعين من الشعور بالولاء ؟
من هذا المنظور وغيره ، كان هذا المشروع البحثي محاولة في تقويم هذه الدعوة إلى تطبيق الشريعة ، بحسب جملة المحاور التي يفترضها كلّ تفكير في الحق عامة ؛ أي من جهة دلالة مفهوم الشريعة ، ومن جهة المفاهيم والمقدمات الأساسية ، التي يُبنى عليها ، ومن جهة الإشكاليات النظرية والعملية التي يؤدي إليها ، وأخيراً من جهة النقد الموجّه إلى هذا المفهوم .
