تعد دراسة المسؤولية الجنائية عن أخطاء الأطباء من الدراسات المهمة في نطاق القانون الجنائي لدولة الإمارات العربية المتحدة "دراسة مقارنة". وفي هذا الكتاب تم التعرض لبحث هذا الموضوع في أربعة فصول مسبوقة بفصل تمهيدي عرض فيه للتطور التاريخي للمسؤولية الجنائية للطبيب، ولقد تم التوصل فيه إلى أن الأصل التاريخي للمسؤولية الجنائية للطبيب يعود إلى التشريعات القديمة، حيث وجد أن قانون حمورابي قد عاقب الطبيب الذي يفقأ عين المريض بقطع يده، وكذلك أقرت الشريعة الإسلامية مسؤولية الطبيب وأخضعته لعقوبة قررتها شرعاً إذا ما تسبب في موت المريض.
وفي الفصل الأول تم التعريف بالمسؤولية الجنائية، وعرض فيه لما هية المسؤولية الجنائية وكونها التزاماً يقع على مرتكب الجريمة. وفي المبحث الثاني تم التعريف بالعمل الطبي من حيث ما هيته وكونه ينحصر في الفحص والتشخيص والعلاج والرعاية اللاحقة للمريض. أما الفصل الثاني فخصص لمسألة الخطأ الطبي وفيه تم تناول الخطأ الطبي وأنواعه ودرجات الخطأ الطبي وطرق إثباته.
أما الفصل الثالث فجاء لتحديد نطاق الجرائم الناجمة عن الخطأ الطبي وقال بأنها تقسم إلى جريمة القتل الخطأ، وجريمة الإجهاض، جريمة الإيذاء خطأ. وفي الفصل الرابع تم تحديد حالات انتفاء المسؤولية الجنائية الناجمة عن الخطأ الطبي، وفي هذا الفصل تم التعرض لحق الطبيب في ممارسة العمل الطبي، وقيد هذا بشرطين هما الترخيص القانوني واتباع أصول الفن، كما وتم التعريف بحالة الضرورة العلاجية، وذلك بعد تبيان شروطها في قانون العقوبات وقانون أصول المهنة الطبية، ومن ثم تم التعرض لموضوع انتفاء القصد الجنائي عن فصل الطبيب ولموضوع انتفاء الخطأ.
