يأتي هذا الكتاب كدراسة قانونية تطبيقة في موضوع الرسم البلدي على القيمة التأجيرية في التنازع الضريبي، ونظراُ لكون هذا الرسم يطال القسم الأكبر من المواطنين والادارات، يعالج الكاتب هذا الموضوع وفق القانون رقم 60/ 1988 المتعلق بالرسوم والعلاوات البلدية في لبنان ويقتصر على الرسم المذكور دون سائر الرسوم والعلاوات الأخرى المبينة والمفروضة في أحكام هذا القانون، وتأتي هذه الدراسة على ضوء نصوص التشريع الحالي في لبنان، والتشريعات السابقة المتعاقبة منذ نشأة هذا الرسم والاجتهاد الغزير الصادر عن مجلس شورى الدولة بصفته المرجع الإستئنافي في قضايا الضرائب والرسون في التنازع الضريبي.
وفي هذه الدراسة يجتهد المؤلف في تفسير الأحكام القانونية إنطلاقاً من المبادئ العامة التي ترعى القانون الإداري عامة والقضايا الضريبية خاصة ويعرج إلى ما توصل إليه أجتهاد المحاكم المختصة في هذا الإطار إضافة إلى مختلف الإستشارات والآراء الصادرة عن هيئة التشريع والإستشارات في وزارة العدل وديوان المحاسبة.
ونظراُ لأهمية الموضوع المطروح تشتمل هذه الدراسة على فصل تمهيدي وقسمان: القسم الأول جاء بعنوان: تحقق الرسم البلدي على القيمة التأجيرية والثقافي في التنازع الإداري، ويضم اثنتا عشرة فصلاً.
وفي ختام الدراسة يخلص الباحث إلى أن الرسم البلدي على القيمة التأجيرية وخلافاً لباقي الرسوم المفروضة في قانون الرسوم والعلاوات البلدية... هو أقرب إلى الضريبة منه إلى الرسم بالمفهوم التقليدي للكلمة ويبقى رسماً يؤدي مقابل خدمات محلية عامة خلافاً لضريبة الأملاك المبنية التي تفرض أيضاً على القيم التأجيرية وانطلاقاً من نفس القواعد والمفاهيم لجهة مطرحها وأصول ترققها وجبايتها، والتي تعتبر ضريبة تؤدي إلى الدولة دون أي مقابل.
هذا الكتاب دراسة قانونية ذات أهمية تستند إلى أولاً- القانون رقم 60/ 1988، ثانياً: القانون رقم 210 تاريخ 26/5/ 2000، والقرار رقم 1719/ 1 تاريخ 24/ 11/2003.
