تعتبر نظرية الإثبات من أهم النظريات القانونية وأكثرها تطبيقاً في الحياة العملية أمام القضاء بل هي النظرية التي تطبقها المحاكم كل يوم فيما يعرض عليها من دعاوى.
وذلك لأن الحق الذي لا يمكن إثبات مصدره سواء أكان تصرفاً قانونياً أم واقعة قانونية يعتبر من الناحية الواقعية متجرداً من قيمته، وقد قسم الفقهاء طرق الإثبات إلى أقسام مختلفة منها: أدلة مباشرة وأدلة غير مباشرة، فالأدلة المباشرة هي التي تنصب دلالتها مباشرة على الواقعة المراد إثباتها وهذه هي الكتابة والشهادة.
وأدلة غير مباشرة هي التي لا تنصب دلالتها مباشرة على الواقعة المراد إثباتها ولكن تستخلص من طريق الإستنباط وهذه هي القرائن والإقرار واليمين، والشهادة من أدلة الإثبات المحددة أصلاً وإستثناءاً تكون لها قوة إثبات مطلقة، وقد كان للشهادة المقام الاول في الإثبات واعتبرت من أفضل وأقوى البيانات على الإطلاق وكانت الشهادة فوق الكتابة وسبب ذلك أن القاضي كان يعرف أكثر أفراد مجتمعه ويعلم مقدار صدق كل واحد منهم ومدى إدراكه للأمور ولم يكن يخشى تقادم الزمان وتأثيره على ذاكرة الشهود، إلا أنه قد تشوب شهادة الشهود من المحاباة والإنتقام والرشوة وفساد الذمة والكذب والمبالغة أو مجرد الخطأ والتقدير الشخصي.
ونظراً لأهمية الشهادة في الإثبات فقد اخترها المؤلف موضوعاً للبحث، وقد قسم بحثه إلى فصلين، عالج في الأول تعريف الشهادة وإجراءاتها وأنواعها وأركانها وخصائصها، وفي الثاني تحدث عن نطاق الإثبات بالشهادة.
