يُعدّ الإحتجاج تصرّفاً صادراً من جانب واحد وهو بهذا المعنى يلعب دوراً أساسياً في التعبير عن إرادة الدّولة في رفض موقف معين أو سلوك محدّد يصدر عن شخص آخر من أشخاص القانون الدّولي، فالإحتجاج يكتسب جانباً جوهرياً من أهميته عبر طروحات المذهب الإرادي، ومن منّا قادرٌ على إنكار الدّور الحيوي الذي لعبتهُ هذهِ المدرسة القانونيّة التي ظهرت في مجال دراسات فقه القانون الدّولي.
لقد أكّد فقه القانون الدولي وما أصدرهُ القضاء والتّحكيم الدوليّين من قرارات وآراء إستشاريّة على وجود حيّز متميّز يلعب فيه الإحتجاج دوراً في تثبيت حقٍ ومنعه من الضّياع أو رفض سلوك غير مشروع يُمكن أن يمثل إنتهاكاً لإلتزام دولي صدر من جانب إحدى الدّول وذلك دفاعاً عن مصالح الدولة المحتجة.
ففي مجال العُرف الدّولي العام والخاص نجد مساحة مهمّة يتحرّك فيها التصرّف ويترك آثراً عند إستعماله، كما نجدهُ أيضاً في نطاق فكرة التقادم المُكسب للأقاليم أو أجزاء منها.
إن الإحتجاج بإعتباره تصرّفاً صادراً من جانب واحد أي أنه ينتمي إلى فئة التصرّفات الدوليّة التي تصدر عن الإرادة المنفردة لشخص القانون الدّولي يجب أن يستوفي شروط الصحّة القانونيّة لكي يكون منتجاً لأثره في مجال العلاقات الدوليّة، وفي ضوء ما تقدم يبرز الدّور المهمّ لهذا التصرّف الذي يصدر عن الإرادة المنفردة لشخص من أشخاص القانون الدّولي.
وقد عالجه المؤلف في هذا الكتاب على وفق الخطة الآتية:

-الفصل الثالث: "القيمة القانونية للإحتجاج"، المبحث الأول: "مكان الإحتجاج في القانون الدولي"، المبحث الثاني: "موقف الفقه والممارسة والقضاء".
