بين يدينا كتاب "صناعة التشريع: مقاربة في العلاقة مع الدين" للدكتور وليد بن محمد الماجد، الذي يحاول فيه تلمس ما إذا كان ثمة قراءة أخرى للعلاقة بين الدين وصناعة التشريع الحديثة، وصولاً إلى بناء إطار مقبول للعلاقة بينهما يلغي التنافر ويحقق الانسجام.
ويعترف المؤلف بصعوبة هذا المبحث، نظراً إلى ما يمكن تسميته بـ(عمق التفرد التاريخي بالسلطة التشريعية وتغييب المجتمع) في التاريخ العربي والإسلامي، ومن جهة نظر أخرى ندرة الكتابة العلمية التي تبحث في بناء علاقة بينية (حميمية) بين الدين والتشريع الحديث، إذ عادة ما يتجاذب الموضوع أطراف اليمين واليسار، وتتسم المواقف بنوع من الحدّة، وهي حدّة ناتجة من الغياب الطويل لآليات الحوار الجاد في سبيل تشريعات تهدف إلى حماية المجتمع. مع العلم أن هذا المجتمع هو الحامي للقيم الدينية، كما للقيم الاجتماعية الحديثة، وتعطيل دوره لا يؤدي سوى للاستبداد في كلا الحالتين.
