تتناول الدراسة في هذا الكتاب بالعرض والتحليل فلسفة العقوبات من أوجه مختلفة، سواء تعلقت بالأسس التي تقوم عليها، مدى التطور الذي طرأ عليها، ومنهج السياسة الجنائية الحديثة في تبنيها لأهدافها في الإصلاح والتأهيل، ومدى انعكاس ذلك على التشريعات الوضعية.
وإذا كان من غير المستطاع تحديد كل أصناف العقوبات وخصائصها في هذه الدراسة فإن التركيز فيها انصب على العقوبات البدنية والعقوبات السالبة أو المقيدة للحرية، باعتبارها الأهم والأكثر تأثيراً في المجتمعات القديمة والمجتمعات الحديثة أيضاً. والمعالجة فيها تضمنت المقارنة بين خصائص هذه العقوبات في التشريعات الوضعية الجزائية والخصائص الواردة في أحكام الشريعة الإسلامية والتي بدأت تحتل موقعاً بارزاً في تلك التشريعات، وتشير اهتمام الباحثين في حقل مكافحة الجريمة لما يتميز به من مرونة وفعالية.
هذا واعتمد المؤلف في إطار بحثه لهذا الموضع إلى عرض أوجه النقد الموجهة إلى هذه الجزاءات.. إلى أوجه الاختلاف القائمة بينهما، على أساس تقسيمه الدراسة على النحو الآتي: القسم الأول: العقوبات البدنية، القسم الثاني: العقوبات السالبة للحرية "عقوبة السجن".
