المقاصد المستقرأة من النصوص تنتجها عقول العلماء بناء على واقعهم ورؤيتهم للعالم والكون، ولذلك صاغت الرؤى التجديدية المعاصرة مقاصد عامة من مثل مفاهيم العدل، والحرية، وبناء الأسرة وكفالة الحريات الدينية، والإصلاح الإجتماعي والسياسي، وحقوق المرأة، وهذا الكتاب يهدف إلى تفعيل المقاصد الشرعية في البحث الأصولي والاستدلال الفقهي، عن طريق دراسة نقدية لبعض مسالك الترجيح والنسخ في الفقه الإسلام، واتخاذ المقاصد منهجاً لحل تعارض النصوص ومناطاً للأحكام الشرعية تدور معه حسب تغير الأحوال حتى إذا اقترن التجديد المعاصر للمصطلح المقاصدي بإناطة الأحكام الشرعية بمقاصدها المستنبطة –كما يقترح هذا الكتاب– كانت المحصلة مرونة متجددة في للفقه الإسلامي، وتحولاً في فقه المقاصد الشرعية من بيان لحكمة التشريع إلى خطة شاملة ومنهج متكامل لتنمية الأمة.
هذا الكتاب توجه إلى موضوع دقيق له خطره وأثره في عملية استنباط الأحكام، لعلاقته بتوسيع أوعية الإجتهاد الفقهي وتجديدها، إذا لم نقل إنه يطمح إلى إيجاد أوعية جديدة غير تلك التي فصلها الأصوليون على مقاس ما فهموه من النصوص الجزئية والقواعد الكلية، وتواضعوا على ألقابها ومصطلحاتها، وحددوا مضامينها، وضبطوا وسائل وسبل تطبيقها.
