تعد محكمة التمييز الاتحادية العراقية، الجهة القضائية العليا من جهات القضاء في الدولة، وتمارس العديد من المهام التي تشترك في تحقيق هدف موحد يتمثل في التطبيق السليم والصحيح للقانون من قبل المؤسسات القضائية المختلفة في الدولة، وتقوم بتوحيد الاجتهاد وإستقراره في المسائل القانونية المعقدة، لتوطيد حرمة القانون والقضاء، وتعزيز شأنها وضمان تحقيق وحدة القضاء، ووظيفتها تنصب اساساً على بحث القاعدة القانونية المختلف عليها، وتفسيرها وتطبيقها، سواء ماتعلق منها بالقواعد الموضوعية، أو بقواعد الاجراءات، والبحث فيما إذا كانت هي القاعدة التي يجب الاخذ بها في النزاع المطروح من عدمه، وبيان ما إذا كان الحكم المطعون فيه قد أخفق في فهمها أو تطبيقها على الواقع المستخلص من الدعوى أو اصاب الفهم السليم. وليس من المبالغة القول، أن تطور القانون ورقيه وتحقيقه الامثل للعدالة في الكثير من الدول كان بفضل الاداء المهني العالي للمحاكم العليا في تلك الدول، وليس خافياً الدور الذي تمارسه محكمة التمييز في تطوير القانون حسب مقتضيات المجتمع المتغيرة بإستمرار مع الجمود الذي تتسم به القاعدة القانونية، فكثيراً ماأوجدت مثل هذه المحاكم المباديء القانونية الجديدة المنسجمة مع ظروف المجتمع وحياة الافراد.
لذلك فان فقه المرافعات مجمع - كما سنرى ذلك لاحقا - على أن هذا الجهاز القضائي يقوم بدورين مهمين في نطاق الدعوى المدنية يتمثل الدور الاول في المحافظة على وحدة تفسير القواعد القانونية التي تطبقها المحاكم، وبهذا التفسير تتأكد وحدة القانون الذي تطبقه هذه المحاكم والدور الثاني يتمثل في مراقبة تطبيق المحاكم للقانون على الوجه الصحيح.
