يتألف هذا الكتاب من قسمين: قسم دراسة، وقسم تحقيق؛ أما قسم الدراسة فوزع إلى خمسة فصول: الفصل الأول: عني بإستجلاء نظام الفتوى في الشريعة الإسلامية، وهو نظام قمين بأن يسعف في ردع المتهجمين على الفتيا والمنتحلين لصناعتها دون علم كاف أو إدراك سوي.
الفصل الثاني: استهل بالحديث عن الحظوة التي ظفر بها المذهب المالكي في الأندلس، وبسط القول عن أسباب تلك الحظوة ودواعيها، ثم أردف ذلك بالحديث عن أمهات المصادر الفقهية التي دارت عليها الفتيا في الأندلس، وترامت آفاق الدرس إلى إستيبان الخصائص التي اصطبغت بها الفتاوى الأندلسية من حيث منهجها في تقرير الحكم وأسلوبها في معالجة النازلة، ورصد مجالات العناية التي ظفرت بها - أي الفتاوى - في كتابات المعاصرين رصداً يتعدّى الوصف والسرد إلى إنتخال الحصيلة وتقويم العطاء.
الفصل الثالث: اجتهد في الترجمة بابن بشتغير ترجمة تفيد في رسم صورة عن معالم نشأته وروافد تكوينه وآفاق تحصيله وشهادات العلماء فيه، وهي وصورة توسّد لها جهد مضن ونصب غير يسير؛ إذ إن المصادر التي ترجمت بالرجل تضنّ علينا بأخبار ومرويات تفيد في رسم ملامح سيرته بخيوط باهرة وألوان بواحة.
الفصل الرابع: تكفل بدرس الكتاب درساً تقويمياً من حيث عنوانه ومضمونه ومنهجه وأسلوبه وأهميته والمآخذ التي شابته وأخلت بإستوائه.
الفصل الخامس: عني بالكشف عن منهاج التحقيق وأسلوبه، وأما قسم التحقيق فأكب على نشر النص نشراً علمياً يصحح المتن ويرمّم العبارة، ويوثق النقول، ويخرج الشواهد، ويعد الفهارس، فضلاً عن بعض التعليقات التي أغنت مضامين النص وفكّت مستغلقاته.
