بين طيات هذا الكتاب دراسة قيمة أعدها وناقشها الباحث "عباس محمد نصر الله" لنيل دبلوم الدراسات العليا في القانون العام في كلية الحقوق والعلوم السياسية والإدارية في الجامعة اللبنانية وهي بعنوان "الغرامة الإكراهية والأوامر في التنازع الإداري" ومما لا شك فيه أن هذه الدراسة، وهي الأولى في موضوعها باللغة العربية سوف تساهم في إغناء المكتبة الحقوقية اللبنانية لأنها تعالج موضوعاً حديثاً يعود تاريخ دخوله في التشريع اللبناني العائد للقانون الإداري إلى أواخر العام 1993 وذلك بموجب القانون رقم 259 تاريخ 1993/10/6 وبدأت اجتهادات مجلس شورى الدولة بخصوصه بالصدور اعتباراً من العام 1995.
وبصورة عامة قسّم الباحث رسالته إلى مقدمة وفصلين وخاتمة. في الفصل الأول بحث الإجراءات السابقة على فرض الغرامة الإكراهية؛ هذا وقد قسّم الفصل إلى عدة أقسام بحث في أولها بتعريف الغرامة الإكراهية وأساسها القانوني، أما ثانيها فأفرده لدراسة الشروط الشكلية لقبول طلب الغرامة الإكراهية في حين ضمّن القسم الثالث دراسة للشروط المتعلقة بالأساس. أما الفصل الثاني فبحث فيه موضوع الإجراءات اللاحقة على طلب الغرامة الإكراهية كمسألة توجيه الأوامر إلى الإدارة وعلاقتها بالغرامة الإكراهية، ومرحلة التحقيق والحكم.. هذا وقد اعتمد الباحث في رسالته هذه، الأسلوب العلمي المجرد الهادف إلى حلّ الإشكالية والوصول بالتالي عن طريق التنقيب إلى الحقائق المتعلقة بهذه الإشكالية وتحليلها تحليلاً نقدياً منطقياً جامعاً بين البحث الاستقرائي والاستنباطي.
هذا الكتاب هو رسالة أعدت لنيل شهادة دبلوم الدراسات في القانون العام نالت درجة جيد جداً مع تنويه اللجنة بضرورة نشره لأنه المرجع الأول في العالم العربي الذي يتناوله هذه الدراسة والتي تتمحور حول تنفيذ الأحكام القضائية الصادة عن مجلس شورى الدولة وفرض الغرامة الإكراهية على الدولة لإرغامها على التنفيذ. وقام الباحث بالمقارنة بين التشريعين اللبناني والفرنسي وعمد إلى سدّ الثغرات التي يحويها التشريع اللبناني في هذا الشأن وبحث مسألة شديدة الحساسية وتتعلق بإمكانية توجيه القاضي أوامر إلى الإدارة.
