هذا كتابنا في أحكام المواريث نقدمه لطلاب الفقه الإسلامي والراغبين في الاستزادة منه شرحنا فيه قانون المواريث رقم 77 لسنة 1943 بطريقة جديدة، وترتيب مبتكر، نبدأ المسألة بذكر أدلتها من كتاب الله وسنة رسوله أو إجماعات الصحابة وفتاويهم، ثم نعرض لآراء الفقهاء فيها إن وجد فيها اختلاف، لنرسم للقارئ صورة صادقة عن الفكر الإسلامي في البحث والاستنباط ولنبين له ما أخذ به القانون من أقوال الفقهاء ليرى بعد ذلك إن كان حالفه التوفيق في اختياره أو جانبه الصواب فيما أخذ به.
ولم ندخر وسعا في شرح الألفاظ الاصطلاحية التي تبدو غريبة على من لم يتزود من الفقه الإسلامي بزاد وفير وفي أتباع كل نوع بأمثلة توضح القواعد وتنير الطريق أمام المطبقين لأحكامه، وقد رتبته على مقدمة وستة أبواب وتتمة وخاتمة.
أما المقدمة ففي تاريخ تشريع الميراث والتعريف به وحكمة مشروعيته والتعريف بقانونه. وأما الأبواب: فالباب الأول في التعريف بالتركة والحقوق المتعلقة بها، والباب الثاني في أسباب الإرث وشروطه وموانعه. والباب الثالث في أنواع الإرث المتفق عليها وهي الإرث بالفرض والتعصيب. الرابع في الحجب والرد وأصول المسائل وتصحيحها. الخامس في إرث ذوي الأرحام. السادس في الاستحقاق بغير الإرث، والإرث بالتقدير والاحتياط.
