تهتم الدول بالحفاظ على حقوق وحريات الأفراد، فتصدر التشريعات المختلفة لحمايتها، فإحترام هذه الحقوق يُعدّ مقياساً لتقدم ورقى الأمم.
ووظيفة القانون هي تنظيم المجتمع، بغية الحفاظ على حريات ومصالح الأفراد الخاصة، مع حفظ كيان المجتمع بإقرار النظام فيه، وكفالة المصلحة العامة، مع التوفيق بينها وبين المصلحة الخاصة للأفراد.
وللحق في الحياة الخاصة مكانة سامية على المستوى الدولي، حيث عنيت هيئة الأمم المتحدة بإصدار الإعلانات والإتفاقيات المتعلقة بحقوق الإنسان، ومنها حقه في حياته الخاصة.
وعلى الصعيد الإقليمي، فقد اهتمت الإتفاقية الأوروبية لحقوق الإنسان ببسط الحماية اللازمة للحق في الحياة الخاصة، والحق في الحياة الخاصة قديم قدم البشرية.
فقد حرصت الأديان السماوية على تقديس ذلك الحق تأكيداً لكرامة الإنسان وتفضيله على سائر المخلوقات.
وتأتي هذه الدراسة لتتناول حق الإنسان في حماية الخاصة في القانون الدولي والتشريعات الداخلية، وقد قسمّها المؤلف إلى فصلين تفرعت إلى عدة مباحث ثم توزعت إلى عدة مطالب وفق الخطة الآتية: الفصل الأول: مفهوم حقٌ الإنسان في حماية حياته الخاصة، المبحث الأول: ماهية حقٌ الإنسان في حياته الخاصة، المطلب الأول: التعريف بحقٌ الإنسان في حماية حياته الخاصة وأهميته، المطلب الثاني: التطور التاريخي لحقٌ الإنسان في حماية حياته الخاصة، المطلب الثالث: الأخطار التي تهدّد حقٌ الإنسان في حماية حياته الخاصة، المبحث الثاني: الطبيعة القانونية لحقٌ الإنسان في حماية حياته الخاصة، المطلب الأول: الخصائص القانونية لحٌق الإنسان في حماية حياته الخاصة، المطلب الثاني: عناصر حقٌ الإنسان في حماية حياته الخاصة، المطلب الثالث: نطاق الحق في الحياة الخاصة.
أما الفصل الثاني: آليات حماية حقٌ الإنسان في حياته الخاصة، المبحث الأول: الحماية الدولية والإقليمية لحق الإنسان في حياته الخاصة، المطلب الأول: المؤتمرات الدولية والإقليمية ودورها في حماية الحق في الحياة الخاصة، المطلب الثاني: الإتفاقيات العالمية والإقليمية، المبحث الثاني: الحماية الوطنية للحق في الحياة الخاصة، المطلب الأول: الحماية الدستورية للحق في الحياة الخاصة، المطلب الثاني: الحماية القانونية للحق في الحياة الخاصة.
وقد ذيّلتْ هذه الدراسة بخاتمة تتضمن النتائج التي تمّ التوصل إليها، وتقديم بعض التوصيات التي تتعلق بموضوع الدراسة.
