Book Description
نظم المشرّع اللبناني أحكام التمثيل التجاري في المرسوم الإشتراعي 34/ 76 الصادر بتاريخ 5/8/ 1967 وتعديلاته، حيث نصت المادة الأولى منه المعدلة وفقاً للمرسوم / 9636/ تاريخ 6/ 2/ 1975 على ما يلي: "الممثل التجاري هو الوكيل الذي يقوم بحكم مهنته الإعتيادية المستقلة ودون أن يكون مرتبطاً بإجارة خدمة بالمفاوضة لإتمام عمليات البيع والشراء أو التأجير أو تقديم الخدمات ويقوم بهذه الأعمال بإسم المنتجين أو التجار ولحسابهم".
"ويعتبر أيضاً بحكم الممثل التجاري التاجر الذي يقوم لحسابه الخاص ببيع ما يشتريه بناء لعقد يتضمن إعطاء صفة الممثل أو الموزع الوحيد بوجه الحصر".
الرأي السائد لدى المحاكم أن التمثيل التجاري في لبنان يؤدي إلى حق الممثل الحصري لمنتجات المؤسسة ضمن حدود المنطقة المعينة، وإذا أقدم شخص ثالث على إستيراد بضاعة من السوق الدولية الحرة من نفس البضاعة التي لها ممثل في لبنان رأيت المحاكم أنه يجوز إباحة الإستيراد تمشياً مع روح التشريع اللبناني.
