في هذا الكتاب نتناول عقود التجارة البحرية وما يترتب عليها من آثار وبيانات طرق التعامل المعمول بها سابقاً وحالياً بعد أن تجسدت في عقد ينظم العلاقات بين أطراف العقد كذلك نستعرض التشريعات ذات العلاقة في التأمين البحري وما يترتب عليه من إلتزامات لأطراف عقود التجارة البحرية والتي لا يمكن لهذه التجارة أن تتحرك بشكل منتظم دون معرفة هذه الإلتزامات والبيانات التي تتعامل بها خاصة إذا أخذنا بنظر الإعتبار أن النقل البحري يمثل العمود الفقري والركيزة الأساسية لحركة التجارة الخارجية كما يؤدي إلى نقل البضائع وتسليمها في الزمان والمكان المحددين لها، غير أنه في مجال التجارة الدولية فإن النقل البحري للبضائع يشكل النوع الأكثر شيوعاً ذلك أن حصته تمثل حوالي ثلاثة أرباع التجارة الدولية وترتبط عملية النقل البحري للبضائع بإعتبارها وسيلة مادية بتصرف قانوني هو عقد النقل البحري، وقد حدثت تطورات تكنولوجية جذرية للنقل البحري في الفترة الواقعة ما بين إتفاقية بروكسل عام 1924م، 1968م وإتفاقية هامبورغ عام 1978م مما دفع البعض أن يطلق عليها الثورة التكنولوجية في الملاحة البحرية، ومن مظاهر هذه الثورة مشاركة الدول النامية في النقل البحري للبضائع الذي يعد من ركائز التبادل التجاري الدولي في الوقت الحاضر.
شكلت إتفاقية بروكسيل لسنة 1924 الإطار القانوني لوضع حد للنزاع الذي يمكن أن ينشأ بين الناقل والشاحن، وذلك لتجاوز بعض الشروط المجحفة التي يمليها الناقل على الشاحن، حيث دخلت هذه الإتفاقية حيز التطبيق في 2 يونيو 1931، وصادقت عليها عدة دول، ينحصر مجال تطبيق الإتفاقية المذكورة على العلاقات والمعاملات ذات الطابع الدولي، وتضم عشرة مواد حيث تقتضي المادة الأخيرة منها، على أن أحكام هذه المعاهدة تسري على كل وثيقة شحن تصدر في إحدى الدول المتعاقدة، وهذا يعني أن تطبيق أحكام هذه الإتفاقية يتوقف على وجود سريان أحكامها على النقل البحري، ويتمثل هذا في مكان إصدار وثيقة الشحن التي يجب أن تصدر في إحدى الدول، ولا زالت هذه الإتفاقية تشكل مصدراً من مصادر قانون التجارة البحرية.
