نعيش اليوم في عصر إنسداد باب العلم بالتشريعات الإلهيّة بسبب غيبة المعصوم، وما بين أيدينا من ظواهر الآيات القرآنية، وأخبار الآحاد، والإجماعات المنقولة، والشهرة الفتوائيّة، والقياس، والمصالح المرسلة، وسدّ الذرائع... وغيرها من الطرق، لا تفيد إلاّ الظنّ بالحكم الشرعي، وهذا يضع عملية الإجتهاد أمام إشكاليّة بنيويّة ومأزق حقيقي، لأنّ ﴿الظَّنَّ لَا يُغْنِي مِنْ الْحَقِّ شَيْئًا﴾، ولنهي المشرِّع عن العمل بغير العلم ﴿وَلَا تَقْفُ مَا لَيْسَ لَكَ بِهِ عِلْمٌ﴾، وعليه: أليست الطرق الظنيّة فاقدة للقيمة المنهجيّة في عملية الإستدلال الفقهي؟ فكيف يسلك الفقيه المناهج الظنيّة في إستنباط القوانين والتشريعات الإسلامية؟.
