يعد القانون الدولي الإنساني، من أقدم فروع القانون الدولي العام، ظهوراً ولا غرو في ذلك، فإذا كانت فروع القانون الدولي العام الأخرى، كقانون التنظيم الدولي والقانون الدولي للتنمية والقانون الدولي للبيئة... قد ارتبط وجودها بظهور الحاجة إلى معالجة قضايا جديدة برزت في الساحة الدولية؛ كظهور المنظمات الدولية كأشخاص دولية جديدة، وظهور فجوة عميقة بين الدول المتقدمة والدول النامية، وبروز الحاجة إلى قواد دولية لحماية البيئة من الأضرار الناجمة عن التصرفات الدولية غير المشروعة، فإن قواعد القانون الدولي الإنساني، تعد أسبق قواعد القانون الدولي العام ظهوراً، فقد ظهرت بدايات هذه القواعد مع بدايات ظهور المجتمع الدولي، وذلك لأن الحروب والنزاعات المسلحة، قد عرقتها الدول منذ بداية تشكيل المجتمع الدولي، وبالتالي كانت الحاجة ماسة - ومنذ ظهور المجتمعات البشرية - إلى وجود قواعد دولية إنسانية، تساهم في التخفيف من المعاناة التي تلحق بضحايا النزاعات المسلحة.
ومن هنا، كانت جذور القانون الدولية الإنساني عميقة وضاربة في التاريخ، بحيث نجدها تعود - كما سنرى - إلى التعاليم السماوية والآراء الفلسفية قبل صياغتها في إتفاقيات وأعراف إنسانية.
فإن دراستنا لهذا القانون تنطلق من الوقوف على ولادة هذا القانون وتطوره، وذلك في فصل تمهيدي، كتوطئة لبحث مادة هذا القانون ونطاقه، وذلك في فصل أول، ومصادر هذا القانون وقواعده العامة في فصل ثاني، وذلك على النحو التالي: الفصل التمهيدي: ولادة وتطور القانون الدولي الإنساني، الفصل الأول: نطاق تطبيق القانون الدولي الإنساني، الفصل الثاني: مصادر القانون الدولي الإنساني وقواعده العامة.
