سعت هذه الرسالة لدراسة موضوع الحضانة للطفل عند الفقهاء المسلمين في التشريع الليبي، فعرفت بداية بالمقصود بالحضانة لغة وشرعاً وقانوناً، من ثم عرضت لحاجة الطفل إلى تشريع الحضانة بصفة عامة وإلى ضرورتها بالنسبة إليه، من ثم تحدث عن دور الأسرة في رعاية الطفل، وركزت على دور الأم من ثم الأب في الشريعة والقانون، وبعد ذلك عرضت لمدة الحضانة أي المدة التي تمتد إليها سنوات حضانة الطفل وفقاً للأقوال الفقهاء والتشريع.
وفي مرحلة لاحقة تناولت بالدراسة نظر الفقهاء في تنشئة الأطفال وتربيتهم في السنوات الأولى، ثم بعد السنوات السبع إلى سن البلوغ والرشد، وتعرضت إلى نظرة المشرع الليبي في هذا الخصوص. كما ودرست من يستحق الحضانة أي من لهم حق الحضانة من الرجال والنساء وما هي الشروط التي يجب أن تتوافر فيهم حتى يسلم لهم الطفل لحضانته.
هذا ولم تغفل الدراسة التطرق لأحكام اللقيط ودور المجتمع في تربيته وفقاً لأقوال الفقهاء والتشريع الليبي، ثم انتهت الدراسة في مزايا كل من أقوال الفقهاء والتشريع.
