على الخط الفاصل بين اختصاص مجلس الأمن ومحكمة العدل الدولية في تسوية المنازعات؛ يناقش هذا الكتاب التداخل في تحديد الاختصاص بين هذين الجهازين في مسالة تسوية النزاعات بين الدولن الأمر الذي طرح العديد من التساؤلات بين فقهاء وشراح القانون الدولي في الآونة الأخيرة حول العلاقة بين مجلس الأمن ومحكمة العدل الدولية بشأن تسوية المنازعات الدولية، وذلك باعتبار أن هذه المسألة لم تثر في السابق بالشكل الذي يحدث الآن وذلك من خلال إقحام مجلس الأمن في مسائل قانونية أثارت شكوكاً حول اختصاص هذا الجهاز وتدخله في اختصاصات الأجهزة الأخرى للأمم المتحدة مثل محكمة العدل الدولية؛ فالنزاع الليبي الغربي كان هو السابقة الأولى التي أثارت هذا الموضوع وذلك من خلال إصدار مجلس الأمن فيه العديد من القرارات في الوقت الذي كانت القضية معروضة أمام محكمة الدولية.
وبناءً على ما تقدم يطرح مؤلف الكتاب عدداً من التساؤلات هي مثار جدل فقهي واسع بين ذوي الاختصاص مثل، ما هي الاعتبارات التي يجب على مجلس الأمن أن يراعيها عند إصداره للقرارات المتعلقة بحفظ السلم والأمن الدوليين؟ أي بمعنى إذا كان لمجلس الأمن الحرية في التدخل أو عدم التدخل في النزاعات الدولية هل يحقق له إصدار ما يشاء من القرارات، أم أن هناك اعتبارات قانونية معينة لا بد أن يلتزم بها عند إصداره للقرارات المعتلقة بالمنازعات الدولية؟... وهل يجوز لمحكمة العدل الدولية باعتبارها الجهاز القضائي الرئيسي للأمم المتحدة القيام بدور رقابي على قرارات مجلس الأمن الدولي في حالة مخالفتها المشروعية؟ والجواب يأتي وفق قواعد وأحكام الفقه والقانون الدولي العام وهو ما يبحثه هذا الكتاب.
