Book Description
تشكّل الحماية الدولية للمدنيين والأعيان المدنيّة، أو ما أطلقنا عليهما مصطلح (ألأهداف المدنيّة)، تبعاً للمفهوم المُخالف لمصطلح (الأهداف العسكرية) الذي يشمل (المقاتلون والأعيان العسكريّة)؛ تحديّاً كبيراً للمجتمع الدولي بشكل عام، وأيضا للدول المتنازعة المعنية بتطبيق قواعد القانون الدولي الإنساني بشكل خاص.
فغالباً ما يُلاحظ أنّ هناك العديد من الانتهاكات الجسمية للاتفاقيات الدولية ذات الطابع الإنساني التي تؤسس للحماية الدوليّة للأهداف المدنيّة، لا سيما اتفاقية جنيف الرابعة لعام 1949، وغيرها من الاتفاقيات ذات الشأن.
كذلك تتجسّد الحماية الدولية من جانب آخر، بجهود المنظمات الدولية سواء أكانت غير الحكومية كاللجنة الدولية للصليب الأحمر، أم حكومية كمنظمة الأمم المتّحدة. وتتركّز جهود هذه المنظمات بسعيها إلى ضمان تنفيذ - أو تطبيق - الاتفاقيات الدّولية، كذلك سعيها إلى وقف انتهاكات هذه الاتفاقيات، أو على الأقل الحدّ منها.
وتحاول الدراسة تأسيس وعي عام في مسألة تجنّب الأهداف المدنيّة؛ ويلا كوارث الحروب والنزاعات، ومآسيها التدميرية الهائلة للأرواح والأجساد والمُمتلكات، من خلال بيان الاتفاقيات الدوليّة المُلزمة بحماية هذه الأهداف، وبيان نوع هذه الحماية، فضلاً عن بيان ماهية الاحتياطات أو التدابير المُلزمة والواجب اتخاذها تحت طائلة المسؤولية من طرف المخططين والمنفذّين العسكريين أثناء سير المعارك والحروب بخصوص خطط وسير العمليات، بما يهدف لتجنّب الأهداف المدنية تاثيرات تلك الحروب.
ومِمّا يؤسف عليه القول: إنّه بالرغم من الجهود الدّولية التي بُذلت من أجل تجنب ضرب الأهداف المدنية، فضلاً عن تنامي الشعور الإنساني الدّولي وتطور الأفكار الإنسانية التي تسود المجتمع الدولي بضرورة حماية هذه الأهداف التي لا علاقة لها بالمجهود الحربي، أو بالنزاع القائم أصلاً؛ فإنّ مشكلة الاعتداء عليها لا تزال قائمة حتى الوقت الحاضر، ذلك بسبب سيطرة النزعة العدوانيّة على بعض أنظمة الحكومات في العديد من الدول.
