أصبحت المحافظة على البيئة وحظر تلويثها، تشكل عبئًا على عاتق الدول في كل الأوقات، سواء في وقت السلم أو في زمن الحرب، وسواء كانت العلاقات بينها عادية أو متوترة، ولا شك أن هذا الالتزام يصبح أشد إلحاحًا في أوقات الحروب والنزاعات المسلحة.
وواقع الأمر إن حماية البيئة الطبيعية في أوقات الحروب والنزاعات المسلحة قد مرت بمراحل عديدة على مستوى القواعد والأحكام، ومن أهم ملامح حياة البيئة أثناء النزاع المسلح ما تضمنته الأعراف والمواثيق الدولية من حظر استخدام وسائل القتال التي تهدف إلى أو يتوقع منها إحداث ضرر واسع وجسيم وممتد زمنيًا بالبيئة الطبيعية.
وفي ضوء ما سبق يأتي تقسيم الدراسة إلى ثلاثة فصول تعقبها خاتمة، يدور الفصل الأول حول بيان الاهتمام الدولي بحماية البيئة، من حيث استعراض مفهوم البيئة وتطور الاهتمام الدولي بحماية البيئة في إطار المواثيق والاتفاقات الدولية. أما الفصل الثاني فيعالج الجوانب الموضوعية لحماية البيئة في القانون الدولي الإنساني وينقسم الفصل إلى: المبحث الأول بعنوان مصادر الحماية البيئية في القانون الدولي الإنساني، أما المبحث الثاني فقد تناول مضمون الحماية البيئية في القانون الدولي الإنساني. وأما الفصل الثالث فتناول آليات حماية البيئة في القانون الدولي الإنساني من خلال مبحثين، تناول المبحث الأول آلية الشكاوي والتقارير والبلاغات الحكومية ولجان تقصي الحقائق، أما المبحث الثاني فقد ركز على المسؤولية الدولية عن انتهاكات البيئة.
