إن الثروة العقارية في لبنان هي من أهم الثروات المتداولة، ويعود الأمر في ذلك إلى مساحة لبنان الضئيلة، بحيث لا تتجاوز العشرة آلاف وأربعماية وثلاثة وخمسين كيلو متراً مربعاً.
ونظراً لأهمية الثروة العقارية هذه، وجدت دافعاً يحدوني إلى بحث مسألة القسمة العقارية، أو إزالة الشيوع، لا سيما وأن غالبية اللبنانيين يملكون، ولو قسماً ضئيلاً من العقارات، الأمر الذي يجعل الفائدة من هذا البحث أكثر تعميماً.
وبما أني قد ترأست الغرفة الإبتدائية في لبنان الشمالي فترة طويلة من الزمن، وكان من إختصاص هذه الغرفة رؤية دعاوى القسمة العقارية، إعتباراً من تاريخ صدور القانون رقم 16/ 82، فقد وجدت من المفيد وضع هذا المؤلف، تحقيقاً لرغبة طلاب القانون، وتسهيلاً لعمل الأساتذة المحامين والسادة القضاة العاملين في هذا الحقل، خصوصاً وأن التضارب في الإجتهاد، كان قد ساد في كثير من النواحي العملية، ونرجو أن نساهم في وضع حد لهذا التضارب، رغبة منا في توحيد النظرة إلى الحلول العملية من أجل تعميم العدالة.
