إن الحواس نعمة عظيمة من الله سبحانه وتعالى على الإنسان، بوصفها وسيلة التواصل بينه وبين الأشياء من حولـه، وهي وسائل الإدراك المباشر في الإنسان، وهي أمانة استودعها الله لدى الإنسان واختبره بها، وبين سبحانه تعظيماً لشأن الحواس أنها ستشهد عليه يوم القيامة بما مارسه من خلالها من أعمال لا ترضيه.
قد يُوْلَدُ الإنسان فاقد حاسة من حواسه، أو قد يكتسب هذه الإعاقة في أثناء حياته لأسباب كثيرة، فما الأحكام المنوطة به؟ وما الأحكام الشرعية التي يتفق فيها مـع معافى البدن؟ وما الأحكام التي يختص بهـا؟ وما حكم عبادة فاقـد الحاسـة ومعاملاتـه وأحواله الشـخصية وجناياته والجناية عليـه؟ وكيف عالجت الشـريعة الإسلامية أحكامه؟
لذلك اختصت هذه الدراسة أحكام الحواس الخمس وحدها دون غيرها، فلم تدرس الحاسة السادسة؛ لعدم تعلق الأحكام الفقهية بها، أو الإحساس بالجوع أو بالخوف أو القلق وما إلى ذلك، واعتمدت الدراسة على المذاهب الفقهية الأربعة.
