إن الطبيعة الخاصّة للقانون الذي يحكم الوظيفة الدّوليّة، يتطلّب وجود جهة قضائية أو جهاز قضائي مستقِلّ ومتميّز، يتَجه إليه موظفو المنظّمات الدّوليّة، والأفراد الذين يتعاقدون معها، أو يصيبهم ضرر بسببها، من أجل رعاية حقوقهم قبل المنظّمة الدّوليّة التي يتعيّن عليها إحترام مبدأ المشروعيّة.
ولكون الدراسة تعنى بموضوع تعويض الموظّف الدولي، فقد تمّ التركيز على أمرين:
-الأول: الضرر الناشئ عن خطأ المنظّمة الدّوليّة.
-الثاني: التعويض على الموظّف الدولي بسبب هذا الخطأ.
وتمّ التعرّض بشيء من التفصيل، للرأي الإستشاري لمحكمة العدل الدّوليّة لعام 1949، "التعويض عن الأضرار المتكبّدة أثناء الخدمة في الأمم المتحدة"، لأهمية هذا الرأي بالنسبة لموضوعنا، كونه تناول الأضرار التي يعانيها موظّفو الأمم المتحدة، إنّ خطأ الإدارة الدّوليّة يجعل قرارها قابلاً للطعن، ذلك إن إلغاء القرارات المجحفة بحقوق الموظفين الناتجة عن إساءة إستعمال السلطة يُعد من أهمّ الضمانات التي توفّر الإستقرار الوظيفي وتحقق الإطمئنان للموظفين الدّوليين.
وهذا ما انتهجته الإدارات الدّوليّة حيث قامت بإنشاء المحاكم الإداريّة، ومنحها الصلاحية لإلغاء القرارات غير المشروعة التي تصدر عن الجهات الإداريّة في المنظّمة، وكذلك التعويض عن تلك القرارات إن كان لها مقتضى، وكذلك تقدير التعويض العادل إذا ما استحال تنفيذ الإلتزام أو أصبح تنفيذه مستحيلاً أو عديم الجدوى.
