تعود بذرة هذا العمل إلى عام 1887، وهي تُولَد من حدث واقعي، كان لتولستوي آنذاك علاقات ممتازة مع النائب العام "أناتول فيدوروفتش كوني" (1840- 1918)، وهو حقوقي شهير، ذو فكر متحرر، ونزاهة خلقية عظيمة، وأفضل ممثل للحقوقيين الروس من جيل 1860.
ولقد أوتي موهبةً أدبية حقيقية، فنشر مرافعاته كما نشر مذكراته، ولاقت نجاحاً كبيراً، وهو الذي قصّ ذات يوم على تولستوي واقعةٌ مؤثرة من حياته القانونية: زاره شاب من المجتمع الراقي أراد أن يسلّم ظرفاً مختوماً إلى إحدى السجينات، وأبت الإدارة عليه ذلك، فقصد النائب العام "كوني" يطلب عونه.
اهتم كوني بالأمر وعلم أن تلك السجينة مومس اسمها "روزالي أوني" وأنها محكومة بسبب سرقتها مائة روبل، لكن كان وراء ذلك قصة طويلة: لقد كانت "روزالي" فلاحة صغيرة يتيمة اشتغلت خادمة لدى سيدة ثرية دللتها، فأغراها ابن تلك السيدة - وهو الشاب الذي قصد النائب العام - وحملتْ منه، وما لبثت أن طُردت من البيت وغرقت شيئاً فشيئاً في الدعارة، وإذ اتُهمت ذات يوم بالسرقة، أُحيلتْ إلى المحكمة التي كان بين محلّفيها ذلك العشيق القديم، فحُكم عليها بالسجن، وعندما تعرّف العشيق تلك الفتاة التي أغواها قديماً، عضّه الندم لأنه دفعها على طريق الهلاك، وعرض عليها الزواج ليكفّر عن خطيئته، لكن البائسة أصيبت بالتيفوس الذي كان يفتك بالسجن حينئذ، وماتت في المشفى، قبل أن يتم الزواج.
