لقد أعطت الشَّريعة الإسلامية الأسرة جلَّ اهتمامها، وأولتها عناية ورعاية خاصة، كما حرصت أشدَّ الحرص على أن تكون العلاقة بين الزوجين علاقة وطيدة، قائمة على أسسٍ متينةٍ من المحبَّة والموَّدة والألفة والسَّكينة والطُّمأنينة والاستقرار، نجد هذا فيما يصوِّره لنا القرآن الكريم، حين يرسم بصورة واضحة السِّمات التي ينبغي أن تكون عليها الأسرة بقول الله تعالى (وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُم مِّنْ أَنْفُسِكُمْ أَزْوَاجاً لِّتَسْكُنُواْ إِلَيْهَا وَجَعَلَ بَيْنَكُم مَّوَدَّةً وُرَحْمَةً إِنَّ فِي ذَلِكَ لآَيَاتٍ لِقَوْمٍ يَتَفَكَّرُون) الروم / 21، وفي قول الرسول (انْظُر إِلَيْهَا فَإِنَّهُ أَحْرَى أَنْ يُؤْدَمَ بَيْنَكُمَا) سنن الترمذي / باب النِّكاح
. ومن أجل الحفاظ على الأسرة ودوامها، فقد جعلت الشريعة الإسلامية مقدمات لعقد الزواج ألا وهي الخطبة، وندبت كلاً من الخاطبين والأهل إلى أن يتعرفوا على بعضهم ضمن قيود وشروط معينة حتى يتم الزواج على أسس متينة من التوافق والمحبة والتواد والتراحم والتعاون، وقد شرع الإسلام لكل من الخاطبين العدول عن الخطبة إذا كانت لديه أسباب مشروعة تمنع من إتمام الخطبة
. ومع مشروعية العدول عن الخطبة وإباحته، إلاَّ أنَّه مقيَّد بالحاجة إليه، حيث إنَّ الأصل فيه الحظر لا الإباحة، لذا كانت مشروعية العدول عن الخطبة لأسباب مشروعة يتعذر معها إتمام الخطبة واستمرار الحياة الزوجية بينهما. إلا أنَّ استعمال هذا الحقّ في غير ما شرع له، يلحق الضَّرر والأذى بالآخرين، سواء أكان العدول من الخاطب أم المخطوبة، وهذا الضَّرر ممنوع في الفقه الإسلامي؛ لما قرَّره الإسلام من قواعد عامة تندرج تحت قوله ( لاَ ضَرَرَ ولا ضِرَار ). سنن الدار قطني / كتاب البيوع
. لذلك؛ فإنَّ العدول عن الخطبة لأسباب غير مشروعة، يعتبر تعسُّفاً في استعمال هذا الحق؛ لما يترتب عليه من أضرار، نهت عنها الشَّريعة الإسلامية عملاً بعموم القاعدة الشَّرعية: ( لا ضرر ولا ضرار )، فكان لا بدَّ من اتخاذ تدابير شرعية للحدِّ من التعسُّف في استعمال هذا الحقِّ.
