Book Description
آثار عقد الزواج هي الآثار المترتبة على العقد، وهي الحقوق والواجبات التي تثبت لكلا المتعاقدين للآخر إذا ما نشأ العقد صحيحاً، حيث أن من المعروف في الفقه الإسلامي أن الشارع لا يرتب آثاراً ـ حقوقاً شرعية ـ على العقد إلا إذا كان العقد قد استوفى شروط انعقاده، وشروط صحته، أما العقد غير المستوفي شروطه، فإنه قد تنشأ بسببه علاقة بين العاقدين، فيعمل الشارع الحكيم على تنظيمها ووضع أحكام لها من حيث إنها أمر واقع، وذلك لحل الخلاف والنزاع بين المتعاقدين.
ومنها العقود غير الصحيحة في الأنكحة، إذ جعل الشارع لبعضها أحكاماً وآثاراً خاصة ترتبت عن أمور نشأت مع وجود هذه العقود غر الصحيحة التي لا يعترف بها الشارع.
والسؤال الذي يطرح نفسه: هل آثار العقود ومنها عقد الزواج من عمل الشارع والعاقدين أم من عمل الشارع فقط ؟
بمعنى أن آثار العقد هل هي الآثار التي حددها ورتبها الشارع على كل نوع من أنواع العقود، أم أن لكل من العاقدين أن يشترط من الشروط بحيث تترتب آثار العقود بموجب هذه الشروط فضلاً عن الآثار التي رتبها الشارع.
ومثال ذلك: عقد البيع فإن آثار عقد البيع التي رتبها الشارع هي نقل ملكية المبيع من البائع إلى المشتري، واستحقاق البائع الثمن، فهل يجوز لأحد العاقدين أن يشترط شرطاً في العقد يترتب عليه أثر، كأن يشترط المشتري تسليم المبيع في مكان معين، أم لا يجوز له ذلك ؟ وفي عقد الزواج هناك آثاراً رتبها الشارع على عقد الزواج كالنفقة والمهر وغيرها ـ سوف نبحثها بالتفصيل ـ، فهل يجوز لأحد الزوجين أن يشترط شرطاً فيترتب عليه أثر جديد كأن تشترط الزوجة على زوجها أن لا تسافر معه ؟
