ما يميز مقاربة فوكو الفلسفية للسجن هو العمل على صياغة تاريخ متشاكل للذات والسلطة، أي تتبع تطور عدد معين من ميكانيزمات السلطة في علاقتها بالذات كموضوع، الأمر الذي مكنه من وضع القارئ أمام جهاز كامل من الممارسات التأديبية، هو ما سمي بالسلطة التأديبية.
الجديد في هذه المقاربة أيضاً هي التأكيد على أن السجن ليس وليداً للنظام الجزائي العقابي في شكله القانوني، وإنما هو وليد التأديبات في تنوع ممارساتها وفضاءاتها من المدرسة إلى الثكنة والمعمل.
لا يمثل السجن أرقى وسيلة عقابية عرفتها المجتمعات المعاصرة، بالعكس فقد حمل معه "فشله" منذ البداية.
لا يتعلق الأمر فقط بولادة الجنوح، وإنما أن ننظر إلى الوجه الآخر المعكوس للفشل، حيث يتم تدبير اللاشرعية بطرق مختلفة و"فعالة".
